TERMS & CONDITIONS

These Terms and Conditions govern the booking and participation in courses provided by Alex Moran Mountaineering Ltd. (“we,” “us,” “our”). By making a booking with us, you (“the participant,” “the customer”) acknowledge that you have read, understood, and agree to comply with these Terms.
If you have any questions about these Terms and Conditions, please contact us before booking.

For the purposes of these Terms and Conditions, the term "course" refers to any day, night, or multi-day activity booked with Alex Moran Mountaineering Ltd., including but not limited to instructional days, full courses, private guiding, overnight expeditions, and trips abroad. This definition applies regardless of whether the booking includes accommodation, transport, or catering.

Throughout these Terms and Conditions, the terms “guide,” “instructor,” and “staff” refer to any individual working on behalf of Alex Moran Mountaineering Ltd. to deliver courses, instruction, or guiding. This includes but is not limited to freelance staff, subcontracted instructors, and directly employed personnel. All such individuals are qualified, insured, and authorised by the Company to operate in accordance with the relevant course standards and safety procedures.

For the purposes of these Terms and Conditions, the term “staff” may also refer to individuals involved in catering, accommodation, or logistical support during a course or trip. While they may not be directly involved in instruction or guiding, these individuals are acting on behalf of Alex Moran Mountaineering Ltd. and contribute to the overall delivery and safety of the course.

1. Bookings, Insurance & Fees
1.1 The total price of the booking is required to reserve your place. Once booked, the Customer Cancellations policy will apply.

1.1.1 Payment plans may be offered at the company’s discretion for specific courses only. Where a payment plan is agreed, you are committing to pay the full course fee in accordance with the agreed schedule.

1.1.2 By entering into a payment plan, you acknowledge that cancellation of your place does not release you from the obligation to complete all remaining payments. You remain fully liable for the full course fee, and no refund will be issued unless otherwise specified in the applicable cancellation policy (see Section 2).

1.1.3 If you cancel your place on a course while a payment plan is in place, all outstanding instalments will remain due and must be paid in full. The company reserves the right to take appropriate action to recover any unpaid balances.

1.2 Where a payment deadline is missed, Alex Moran Mountaineering Ltd. reserves the right to charge a late payment fee of £25 to cover administrative costs. Repeated failures to make payments on time may result in your place being cancelled without refund. All fees must be settled in full before participation in the course. We reserve the right to withhold services or cancel bookings where outstanding balances or admin fees remain unpaid.

1.3 Places on courses may be held provisionally for up to 48 hours to allow time for payment to be made. If payment is not received within this period, the booking may be cancelled and the place offered to others without notice. A booking is only confirmed once full payment has been received, or a payment plan has been agreed in writing with the company.

1.4 All payments must be made in Pounds Sterling (GBP). Alex Moran Mountaineering Ltd. does not accept payment in other currencies. Clients making payments from outside the UK are responsible for ensuring the correct amount is received in GBP after any bank charges, currency conversion fees, or international transfer costs. Any shortfall must be paid in full before the course begins. Accepted payment methods and instructions will be provided at the time of booking.
1.5 All participants on UK courses must have basic travel insurance to cover cancellation and curtailment. It is your sole responsibility to obtain and maintain valid travel insurance that fully covers cancellation or curtailment of your course, including any travel days before and after the course as applicable. You acknowledge and accept that failure to hold such insurance is entirely at your own risk, and the company accepts no liability for any losses, costs, or expenses incurred as a result of not having adequate insurance coverage.
1.6 It is a condition of booking that all participants attending courses held outside the United Kingdom hold valid travel insurance that includes, at a minimum: cancellation, curtailment, loss or damage to baggage, and comprehensive cover for rescue and medical expenses arising from mountain activities in the country where the course is taking place.
You must provide a copy of your insurance certificate to the company no later than seven (7) calendar days after making your booking. Failure to provide proof of adequate insurance within this timeframe may result in cancellation of your place on the course, without refund.

1.7 If you fail to obtain adequate travel insurance as required, the company accepts no liability for any losses you incur as a result, including but not limited to cancellation, curtailment, injury, or medical costs. In such cases, no refund or compensation will be provided beyond what is specified in the company’s standard cancellation policy.

1.8 Gift vouchers are valid for 12 months from the date of issue unless otherwise stated and must be used before the expiry date. Vouchers are non-refundable and cannot be exchanged for cash. Only one voucher or discount code may be used per booking—discounts and vouchers cannot be combined.
1.9 Discount codes provided for specific groups (e.g. returning clients, pair bookings, or special promotions) are only valid for those to whom they were issued. If a code is used incorrectly or fraudulently, you will be required to pay the full course fee, or your booking may be cancelled at the discretion of Alex Moran Mountaineering Ltd.

1.10 Alex Moran Mountaineering Ltd. reserves the right to offer discounts, promotional rates, or special pricing on specific courses at its sole discretion. These offers may be limited in time, scope, or availability and may not apply retrospectively to existing bookings. The Company is under no obligation to match or extend discounts beyond the terms explicitly stated at the time of the offer.
2. Customer Cancellations

2.1 Customer Cancellations – Instruction and Guiding Only. This cancellation policy applies to all courses that do not include accommodation or catering.

2.1.1 If you cancel more than 3 months before the course start date, you will be refunded 75% of the course price.

2.1.2 If you cancel between 3 months and 6 weeks before the course start date, you will be refunded 50% of the course price.

2.1.3 If you cancel less than 6 weeks before the course start date, you will not be entitled to a refund.

2.1.4 Once booked, course dates and days of instruction and guiding are fixed and cannot be adjusted due to weather conditions or customer preference.

2.1.5 If you are unable to attend due to medical reasons, this will be treated as a customer cancellation. Notification must be provided in writing, and any refund will be subject to the terms above.

2.1.6 All cancellations must be submitted in writing by email. The cancellation date is considered the date your written notice is received.

2.2 Customer Cancellations – Courses Including Accommodation and Catering - This policy applies to all bookings that include food, accommodation, and instruction/guiding as a combined package. These courses often involve advance third-party bookings, so the cancellation terms are stricter.

2.2.1 If you cancel more than 4 months before the course start date, you will be refunded 75% of the course price.

2.2.2 If you cancel between 4 months and 8 weeks before the course start date, you will be refunded 50% of the course price.

2.2.3 If you cancel less than 8 weeks before the course start date, you will not be entitled to a refund.

2.2.4 Once booked, course dates and the full package (instruction, guiding, catering, accommodation) are fixed and cannot be changed due to customer preference or weather.

2.2.5 If you are unable to attend due to medical reasons, this will be treated as a customer cancellation. Notification must be provided in writing, and any refund will be subject to the terms above.

2.3 Once booked, all course dates and days of instruction and guiding are fixed and cannot be adjusted due to weather conditions or customer preference.

2.4 The company reserves the right to refuse participation in any course if, in our professional judgement, a participant is deemed medically unfit to take part. This decision is made strictly on safety grounds and is final. If a participant is unable to attend a course due to medical reasons, this will be treated as a customer cancellation. In such cases, the participant must notify the company in writing by email as soon as possible. Any refund will be subject to the terms outlined in the company’s cancellation policy (clauses 2.1 - 2.2).

2.5 All cancellations, regardless of the reason, must be submitted in writing by email to the company. The cancellation notice must include the date of the email, the reason for cancellation, and a clear statement confirming that the customer is cancelling their place on the course. Cancellations are only considered effective from the date this written notice is received.

2.6 In the event that a participant cancels their booking, the company reserves the right to fill the vacated place at its sole discretion. This may be done regardless of whether a refund or credit has been issued to the cancelling participant. The company is under no obligation to inform the customer or share any proceeds from the rebooking.

2.7 Participants understand and agree that trips which include instruction, transport, food, and accommodation are offered as a complete package. These components cannot be separated, substituted, or purchased individually. Attendance on such trips requires that participants are physically fit, medically able, and willing to take part in all scheduled activities. The company reserves the right to refuse or remove any participant who is unable or unwilling to fully engage in the trip itinerary, with no entitlement to refund.

2.8 Any refund issued or offered must be accepted and claimed within 30 calendar days of the offer being made. After this period, the refund will no longer be valid, and no further liability will be accepted unless otherwise agreed in writing.

2.9 Courses will begin promptly as scheduled. The company is not obliged to delay start times for late participants or to repeat missed instruction.

3. Cancellations by Alex Moran Mountaineering
3.1 In the event of cancellation of any booking by Alex Moran Mountaineering, participants will be offered one of the following:
3.1.1 A full refund of the fee paid and deposit; or
3.1.2 A transfer to any other date within 1 year if available.
3.2 If we are forced to cancel or curtail a booking due to strike, riots, acts of war or terrorism, natural disaster, disease epidemic, pandemic or “acts of god,” we accept no liability for return of fees paid prior to cancellation or curtailment. Make sure that these events are covered in your travel insurance.

3.3 In the event that a course is delayed, interrupted, or partially curtailed due to force majeure — including but not limited to severe weather, natural disasters, staff illness, transport disruption, government restrictions, or any other unforeseen event beyond the company’s control — Alex Moran Mountaineering Ltd. is not liable for any resulting loss, inconvenience, or expenses incurred by the participant. No refund or compensation will be provided in these situations. The company will make every effort to adapt the course and maximise the participant experience within the limitations of the circumstances.

3.4 Some courses require a minimum number of participants to run. If minimum numbers are not met, Alex Moran Mountaineering Ltd. reserves the right to cancel or reschedule the course. In such cases, participants will be offered the choice of a full refund or transfer to a future date. The Company is not responsible for any additional costs incurred as a result of such cancellation (including travel or accommodation), and participants are advised to ensure their travel insurance covers this eventuality.

4. Risk & Safety
4.1 As walkers, climbers, mountaineers, or scramblers, we expect and encourage you to be self-reliant and accept responsibility for your own safety in the mountain or outdoor environment.
4.2 We encourage you to discuss what is expected of you in terms of all aspects of safety. Whilst we ensure a high professional standard of instruction, care, and safety, all participants must be aware that participation in outdoor activities involves an acceptance of objective risk and responsibility for the consequences of one’s own actions. This is the essence of an adventurous pursuit.
4.3 Adventurous pursuits, even when undertaken with instructors and guides, involve high levels of uncertainty and potential risk. No specific element of an advertised service can be guaranteed with certainty in such an environment. Furthermore, the safe completion of activities takes priority over the achievement of particular goals.
4.4 We have an excellent safety record, however, during any adventurous activity, there is potential for injury. We require that all participants read this information and understand the potential risks.
4.5 All of the activities are strictly voluntary; it is your own choice to participate in each activity to whatever degree you deem appropriate after due consideration of your own physical health, abilities, and medical condition. You are willing to assume the risk of any medical or physical condition you may have.
4.6 You should have adequate insurance to cover any injury or damage you may suffer or cause while participating, or else you agree to bear the costs of such injury or damage to yourself. We do not provide health or accident insurance for participants.
4.7 All participants are required to complete the 'Medical Questionnaire' which will be sent to you before the start date of your booking. Please Note: if, despite reminders, you do not return this form, it is deemed that you have read, understood, and accepted the above statements and conditions.

4.8 All mountain activities undertaken as part of the course and during the time you are attending the course — including but not limited to hiking, walking, climbing, and scrambling — must be carried out under the direct supervision of a qualified instructor provided by the company. Participants are strictly prohibited from engaging in these activities alone or without an instructor during the course. Failure to comply may result in immediate removal from the course without refund, and the company accepts no responsibility for any incidents arising from unauthorised activity.

4.9 To the fullest extent permitted by law, Alex Moran Mountaineering Ltd. shall not be liable for any loss, injury, damage, or expense incurred by you arising out of or in connection with participation in any course or activity, except where caused by our negligence or breach of statutory duty. Our total aggregate liability shall be limited to the amount paid by you for the course. Nothing in these Terms shall exclude or limit liability for death or personal injury caused by our negligence.

4.10 For safety reasons, Alex Moran Mountaineering Ltd. reserves the right to exclude any participant who is pregnant or has a pre-existing medical condition that, in the professional judgement of the instructor, may put the individual or others at increased risk during the course. Participants must disclose any relevant medical conditions at the time of booking or as soon as reasonably possible. If a participant is excluded on these grounds, no refund or compensation will be given.

4.11 All instruction is delivered in English. It is the participant’s responsibility to ensure they can understand and communicate effectively in English. We reserve the right to exclude participants from activities if language barriers compromise safety.

4.12 All participants are expected to arrive with appropriate, well-maintained personal equipment suitable for the course they are attending. Alex Moran Mountaineering Ltd. reserves the right to inspect and refuse the use of any equipment deemed unsafe, unsuitable, or inappropriate for the planned activities. Where possible, we will make reasonable efforts to provide a suitable replacement or assist the participant in sourcing alternative equipment (e.g. hire or purchase). If a safe and appropriate alternative cannot be provided or obtained in time, we reserve the right to refuse participation in part or all of the course until the participant acquires the required item. No refund or compensation will be issued for time missed due to equipment issues.

4.13 By booking a course, participants confirm they have read and understood any pre-course instructions, kit lists, and fitness requirements issued by the company.

4.14 For safety reasons, the consumption of alcohol or use of recreational drugs is strictly prohibited during any instructional or guided activity, including hill days, climbing sessions, and while under the supervision of Alex Moran Mountaineering Ltd. staff. Participants must not be under the influence of alcohol or drugs at any time during the course hours or while engaged in course activities. Any breach of this policy may result in immediate removal from the course without refund. The company accepts no liability for any costs, losses, or consequences arising from a participant’s removal under this clause.

4.15 Any activities undertaken by participants outside the scope of the course provided by Alex Moran Mountaineering Ltd. — including but not limited to wild swimming, fishing, running, cycling, using a boat or other recreational or outdoor pursuits — are done entirely at the participant’s own risk. These activities are not part of the Company’s instruction, guiding, or supervision, and the Company accepts no responsibility or liability for any injury, loss, or incident arising from such activities. Participants are responsible for assessing the risks involved and for their own safety and wellbeing when engaging in non-course activities during their time on a trip.

4.16 If participants choose to use a bicycle to access mountain routes, climbing areas, or course venues, they do so entirely at their own risk. Alex Moran Mountaineering Ltd. accepts no responsibility or liability for any accident, injury, damage, or loss arising from the use of bicycles, whether on or off-road. Participants are responsible for their own safety, equipment, and decision-making when cycling before, during, or after any course activity.

4.17 Lead climbing is a high-risk activity and is not automatically included in all courses. Alex Moran Mountaineering Ltd. reserves the right to assess the suitability of each participant before allowing them to engage in lead climbing. We may, at our sole discretion, refuse permission for a participant to lead climb if we deem it unsafe, inappropriate, or beyond the scope of the course or the participant’s demonstrated ability. If a participant chooses to lead climb — whether as part of the course or independently — they do so entirely at their own risk, and Alex Moran Mountaineering Ltd. accepts no liability for any injury, accident, or loss resulting from such activity. By choosing to engage in lead climbing, the participant confirms that they understand and accept the inherent risks associated with the activity, including the possibility of falls, gear failure, injury, or death.

5. Insurance and Liability
5.1 We hold full civil liability insurance for the activities we provide up to the value of £5,000,000.
5.2 You must be fully insured for the activity you are undertaking.
5.2.1 In the UK: It is your sole responsibility to obtain and maintain valid travel insurance that fully covers cancellation or curtailment of your course, including any travel days before and after the course as applicable. You acknowledge and accept that failure to hold such insurance is entirely at your own risk, and the company accepts no liability for any losses, costs, or expenses incurred as a result of not having adequate insurance coverage.

5.2.2 Outside of the UK: It is a condition of booking that all participants attending courses held outside the United Kingdom hold valid travel insurance that includes, at a minimum: cancellation, curtailment, loss or damage to baggage, and comprehensive cover for rescue and medical expenses arising from mountain activities in the country where the course is taking place.

5.2.3 You must provide a copy of your insurance certificate to the company no later than seven (7) calendar days after making your booking. Failure to provide proof of adequate insurance within this timeframe may result in cancellation of your place on the course, without refund. Strong cover can be found at: www.thebmc.co.uk.
5.3 You should provide a copy of your insurance cover when attending a course or trip with Alex Moran Mountaineering.

5.4 It is your responsibility to provide valid proof of travel insurance as required by these Terms. Failure to provide acceptable insurance documentation within the specified timeframe will result in cancellation of your booking without refund. The company accepts no liability for any losses, damages, or expenses you incur as a result of not having valid insurance coverage.

5.5 Travel and Transport

5.5.1 Transport may be provided during the course by the company, its staff, or participants using private or hired vehicles. All participants accept the inherent risks associated with travel to, from, and during the course, regardless of the vehicle used or who is driving.

5.5.2 The company is not liable for any accident, injury, delay, loss, or damage arising from travel during the course — including as a driver or passenger — except where such loss or injury results directly from the negligence of the company or its staff.

5.5.3 Participants are liable for any driving offences, parking fines, accidents, or damage caused while driving a vehicle during the course, including hire vehicles or vehicles provided by the company. Drivers must ensure they are legally licensed and fit to drive.

5.5.4 Where participants drive any vehicle during a course or trip — including their own vehicle, a hired vehicle, or any other vehicle operated by them — they do so entirely at their own risk. The company accepts no liability for any fines, penalties, accidents, damage, breakdowns, or other costs incurred through the use of such vehicles. Participants are solely responsible for ensuring that any vehicle they drive is roadworthy, appropriately insured, and legally compliant. All driving fines, parking fines, repair costs, insurance excesses, or related expenses incurred during the course are the full responsibility of the participant.

5.5.5 Alex Moran Mountaineering Ltd. is not responsible for any transport arrangements made between clients, including but not limited to car sharing. If a participant accepts a lift or offers transport to others, they do so entirely at their own risk. The company accepts no liability for any loss, injury, accident, or damage arising from the use of transport provided by another participant.

5.6 Participants are liable for any damage they cause to property (including accommodation, transport, and instructional venues) and for the loss of or damage to any climbing or mountaineering equipment provided by the company during the course. This includes, but is not limited to, ropes, helmets, harnesses, hardware, and protective gear. The company reserves the right to charge the participant for the full replacement or repair cost of any such damage or loss arising from negligence, misuse, or failure to follow instruction.

5.7 We will do our very best to accommodate dietary requirements, food allergies, and preferences where these are clearly communicated to us at the time of booking or well in advance of the course. While we take care in food preparation, we cannot guarantee that meals will be free from all allergens or cross-contamination. Participants accept responsibility for managing their own dietary needs and for bringing any essential medications (e.g., antihistamines, EpiPens). The company cannot accept liability for any allergic reactions, intolerances, or adverse effects resulting from meals provided, unless caused by negligence.

5.8 The company accepts no liability for any injury, loss, or damage sustained by participants while using accommodation provided as part of the course. Participants use such accommodation at their own risk and are responsible for their own safety and conduct during their stay.

5.9 We are not liable for any changes to the planned itinerary or for the curtailment of a day in the mountains due to the behaviour, fitness, ability, injury, or medical condition of any participant. While we will always aim to adapt the course to ensure a valuable and enjoyable experience for all, we cannot guarantee equal outcomes or uninterrupted activity. The behaviour and conduct of other participants is not the responsibility of the company.

5.10 Participants who arrive late, miss the start of the course, fail to attend without notice, leave part-way through, or are unable or unwilling to continue for any reason will not be eligible for a refund, credit, or alternative dates. This includes, but is not limited to, fear, fatigue, loss of motivation, homesickness, panic attacks, mental health crises, injury, illness, or missed travel connections such as delayed or cancelled flights. No part of the course may be rescheduled or repeated for individuals in these circumstances. Participants are strongly advised to ensure their insurance covers such eventualities.

5.11 It is the responsibility of each participant to ensure they have valid travel documents, including passports, visas, or any other required permissions for travel. Alex Moran Mountaineering Ltd. accepts no liability for any costs, loss, or inconvenience incurred due to denied entry, invalid documentation, visa issues, or other border-related problems. No refunds or compensation will be provided in such circumstances.

5.12 Alex Moran Mountaineering Ltd. is not responsible for the loss, theft, or damage of personal belongings during the course, including at accommodation venues, in vehicles, or on the hill. Participants are responsible for the safekeeping of their own possessions at all times.

5.13 Alex Moran Mountaineering Ltd. accepts no responsibility for the safety, suitability, or condition of equipment lent, shared, or borrowed between participants. Any use of participant-owned gear not supplied by the company is entirely at the user’s own risk. The company is not liable for any injury, loss, or damage resulting from the use of such equipment, whether it was voluntarily shared or informally recommended by another participant.

5.14 All participants are expected to have an appropriate level of fitness for the course they are attending. It is your responsibility to ensure you meet the physical demands of the course, and to undertake any necessary training in advance. Course descriptions and pre-course materials may include guidance on the required fitness level — these must be read carefully. Alex Moran Mountaineering Ltd. reserves the right to exclude any participant from an activity if, in the judgement of the instructor, their physical condition poses a risk to their own safety or the safety of the group. No refund or compensation will be provided in such cases.
6. Instruction
6.1 We are qualified and experienced to the required level for each activity undertaken and have received training to deliver these to the highest standard.
6.2 We reserve the right to exclude any member from participation in planned activities if they might endanger the success or safety of the rest of the party through lack of fitness, ill-health, poor acclimatisation, or dangerous technique. No refunds will be made to members so excluded.
6.3 Any members who act in contravention of the decisions or advice given during instruction, or otherwise undertake independent activities during the period in which they are in our care, will forfeit all professional protection and duty of care provided.

6.4 Alex Moran Mountaineering Ltd. may, at its discretion, use subcontracted instructors or freelance guides to deliver parts of a course. All such instructors are fully qualified, insured, and operate to the same high standards of safety, professionalism, and legal responsibility as our directly employed staff. Participants agree that instruction may be provided by any suitably qualified member of our guiding team and that all terms, liabilities, and responsibilities outlined in these Terms and Conditions apply equally to subcontracted staff.

6.5 The assignment of a specific guide, including Alex Moran, is not guaranteed. You may be guided by any suitably qualified and experienced member of our team. All guides operate to the same professional standards to ensure a high-quality and safe experience. Changes to guiding staff may occur at short notice due to operational requirements, including but not limited to illness, weather conditions, or cancellations.

6.6 From time to time, Alex Moran Mountaineering Ltd. may include a trainee instructor or guide on a course to observe and learn from qualified staff. This is part of our commitment to supporting the next generation of instructors and contributing to the sustainability and professionalism of our industry. Trainees will not negatively impact your course experience; they are there to learn and will often enhance your time with us by contributing positively to the learning environment.
7. Course Objectives and Weather Conditions
7.1 While we strive to achieve any specific objectives set for the course or days out, weather and environmental conditions may impact our ability to complete them. Safety is always our top priority.
7.2 In cases where conditions prevent us from reaching a particular goal, we will adapt the itinerary accordingly, ensuring you still receive a full day of instruction and outdoor experience. We will make every effort to provide an engaging, valuable day, tailored to the circumstances.

7.3 Winter conditions in the mountains are highly variable and cannot be guaranteed. All winter courses will run as scheduled regardless of snow, ice, or general weather conditions. While specific winter objectives (such as ice climbs or classic snow gullies) may not always be possible, Alex Moran Mountaineering Ltd. will always aim to deliver a high-quality experience tailored to the conditions available. We will adapt each day to ensure you receive valuable instruction, safe mountain experiences, and the best possible use of the time, based on prevailing weather and terrain conditions. No refunds or date changes will be offered due to lack of winter conditions.

7.4 The decision of the lead guide or instructor is final in all matters of safety, route selection, weather assessment, and instructional decisions during the course.
8. Objective-Based Activities and Weather Conditions

8.1 Completion of specific objectives (such as full traverses, summits, or technical routes) is dependent on weather and environmental conditions. We will use course days flexibly to make the best use of available conditions in pursuit of these goals.

8.2 Where conditions make the original objective unachievable, we will adapt the plan to deliver a relevant and challenging alternative — such as sections of the route, skills development, or comparable activities. Safety and good judgement will always guide our decisions.

8.3 The decision of the lead guide or instructor is final in all matters of safety, route selection, weather assessment, and instructional decisions during the course.

9. Data Protection
9.1 We operate in accordance with the requirements of the General Data Protection Regulation, the Data Protection Act 2018, and any other applicable law amending, supplementing, modifying, or otherwise relating thereto.
9.2 We do not sell, rent, or lease our customer information to third parties.
9.3 We reserve the right to use photography and video content taken during activities on our social media sites and website but only of the event itself and with the consent of the individual. Consent will be requested via a checkbox at the time of filling out the medical form and can be withdrawn at any time by contacting us.

9.4 We process your personal data in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018. Your data will be used solely for the purposes of course administration, safety, and communication. We retain personal data only as long as necessary and you have rights to access, correct, or request deletion of your data by contacting us at info@alexmoranmountaineering.co.uk. For full details, please see our Privacy Policy https://www.alexmoranmountaineering.co.uk/privacy-policy.
10. General
10.1 Participation in our courses is open to anyone who meets the necessary experience, health, and fitness requirements for their chosen course. All participants under the age of 18 must be accompanied at all times by their legal parent or guardian throughout the duration of the course. This requirement applies to all courses, regardless of location, duration, or type. The parent or guardian is fully responsible for the welfare, conduct, and supervision of the under-18 participant at all times. Unaccompanied minors will not be permitted to take part in any course.
10.2 For safety and suitability, we reserve the right to decline participation if we determine that a participant's skill level, fitness, or health does not align with the demands of the course.

10.3 We reserve the right to remove any participant from a course without refund if, in our professional judgement, their behaviour is unsafe, offensive, abusive, disruptive, or otherwise inappropriate. This includes conduct that endangers themselves, other participants, staff, instructors, or members of the public, or that compromises the delivery or safety of the course. Such decisions are final and made solely for the safety and wellbeing of all involved. The company accepts no liability for any costs, losses, or expenses incurred by the participant as a result of their removal from the course under this clause.

10.4 The company reserves the right to cancel a participant’s booking before a course or remove them from the course, without refund, if their communications with company staff or other participants are deemed by the company to be inappropriate, offensive, aggressive, discriminatory, or otherwise unacceptable. This applies to all forms of communication, including email, phone, messaging, and social media. The company will not be liable for any costs, expenses, or losses incurred by the participant as a result of their removal in such circumstances.

10.5 Participants are expected to treat all accommodation used during a course with respect and care. This includes adhering to any house rules provided by the accommodation provider. Smoking, illegal drug use, and excessive alcohol consumption are strictly prohibited within the property. Participants will be held liable for any damage, additional cleaning costs, or losses arising from their actions. Alex Moran Mountaineering Ltd. reserves the right to remove any participant from a course without refund if their behaviour in accommodation is deemed unsafe, disruptive, or disrespectful.

10.6 Lost or Left-Behind Equipment. Any personal items or equipment left behind at the end of a course, or accidentally taken in error, remain the responsibility of the participant. Alex Moran Mountaineering Ltd. is not responsible for storing, replacing, or returning lost items. If return by post is requested and agreed, all associated costs (including packaging, postage, and insurance if required) must be paid by the participant in advance, and return will only be arranged once payment has been received. The Company accepts no responsibility for items lost or damaged in transit.
10.7 The information on our website is for guidance. We make every effort to ensure it is correct but cannot be responsible for any inaccuracies or subsequent alterations of services beyond our control.
10.8 If you have a complaint about the service you receive at any point during your booking and days out, you must notify us as soon as possible to give us the opportunity to put things right. In the event of a dispute or complaint, both the participant and Alex Moran Mountaineering Ltd. agree to first attempt to resolve the matter informally through open and respectful communication. All complaints must be submitted in writing by email, and the resolution timeframe begins from the date the complaint email is received by the company. We aim to acknowledge all complaints within 14 days and to resolve them within 30 days of receipt.
10.9 Making your booking implies that you understand and accept these terms and conditions and agree to abide by them.

10.10 These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Scotland. This does not affect your statutory rights under the consumer laws of your home country.

10.11 We reserve the right to update or amend these Terms and Conditions at any time. Any changes will be published on our website. It is your responsibility to review the Terms before your course.
